These Terms of Use (“Terms”) govern your access to and use of zoke.ae (the “Website”) and any related products, features, and services (collectively, the “Services”) operated by SIWARAH FZC (“Company”, “we”, “us”, “our”), owner of the ZOKE JEWELS brand.

By accessing or using Services that require acceptance of these Terms, including placing an order, creating an account, submitting certain forms, or completing a transaction, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.

Participation in the ZOKE Partner Program is additionally governed by the ZOKE Partner Program Terms.

1. Use of the Website

You may browse publicly available areas of the Website for lawful personal or informational purposes.

Certain features, including placing orders, managing an account, submitting inquiries, applying to programs, or completing transactions, may require you to provide personal information or agree to additional terms.

You agree not to:

However, variations may occur due to photography, display settings, handcrafted production, natural materials, gemstone characteristics, manufacturing tolerances, or other reasonable factors.

Product descriptions, prices, specifications, and availability may be changed without prior notice.

5. Prices

Prices displayed on the Website are presented in the applicable currency shown at the time of purchase.

Taxes, delivery charges, customs duties, or other applicable charges may be shown separately where relevant.

We reserve the right to correct obvious pricing, typographical, technical, or display errors.

If a material pricing error affects an order, we may contact you to confirm whether you wish to proceed at the correct price or cancel the affected order.

6. Orders

Submission of an order does not necessarily constitute final acceptance by ZOKE.

We may refuse, hold, investigate, or cancel an order where reasonably necessary, including in cases involving:

• suspected fraud;
• incorrect pricing;
• product unavailability;
• payment failure;
• incorrect customer information;
• security concerns;
• regulatory or compliance requirements; or
• other circumstances that reasonably prevent us from completing the transaction.

7. Payment

Available payment methods are displayed during checkout.

Payments may be processed through third-party payment providers and financial institutions. Your use of such services may also be subject to the provider's applicable terms and privacy practices.

We reserve the right to require additional verification before accepting or completing a payment where reasonably necessary.

8. Identity Verification and AML/KYC Compliance

To comply with applicable legal, regulatory, banking, payment-provider, fraud-prevention, and risk-management requirements, SIWARAH FZC may require customers to provide government-issued identification or other supporting information for certain transactions, particularly high-value transactions.

• perform Anti-Money Laundering or Know Your Customer checks;

Delivery availability, estimated delivery times, fees, locations, and related conditions are described through the Website or our applicable delivery information.

Delivery estimates are estimates unless expressly stated otherwise.

Delays may occur due to circumstances outside our reasonable control, including customs, logistics providers, weather, public holidays, security events, regulatory requirements, or incorrect delivery information.

10. Returns, Refunds and Exchanges

Returns, refunds, exchanges, cancellations, and related customer rights are governed by the applicable ZOKE policy displayed on the Website and any mandatory rights available under applicable law.

Certain products, including customized, personalized, resized, made-to-order, or specially produced items, may be subject to different conditions where permitted by law.

11. Custom Jewelry

Custom, bespoke, personalized, or specially commissioned jewelry may require additional specifications, approvals, deposits, production timelines, or contractual terms.

Where separate terms are provided for a custom order, those terms will apply in addition to these Terms and will prevail in the event of a direct conflict relating specifically to that custom order.

12. Intellectual Property

Unless otherwise stated, the Website and its content, including the ZOKE name, ZOKE JEWELS brand, logos, trademarks, product designs, photographs, videos, text, graphics, layouts, artwork, software, and other materials, are owned by or licensed to SIWARAH FZC and are protected by applicable intellectual property laws.

Except where expressly permitted in writing, you may not reproduce, distribute, publish, modify, copy, sell, license, exploit, or commercially use Website content or ZOKE intellectual property.

Approved ZOKE Partners may receive limited rights to use specifically authorized ZOKE materials in accordance with the ZOKE Partner Program Terms.

13. Reviews, Submissions and User Content

If you submit reviews, comments, photographs, feedback, suggestions, or other content to ZOKE, you represent that you have the right to submit that content and that it does not violate applicable law or third-party rights.

You must not submit unlawful, defamatory, misleading, fraudulent, infringing, abusive, or harmful material.

14. Promotions and Discount Codes

Promotions, referral codes, discount codes, gift offers, competitions, or other promotional campaigns may be subject to separate conditions.

Unless otherwise stated, promotional benefits:

• may have expiry dates;
• may apply only to selected products;
• may not be combined with other promotions;
• may be limited by customer, order, country, or campaign;
• may be withdrawn where fraud or misuse is suspected; and
• have no cash value unless expressly stated otherwise.

15. ZOKE Partner Program

ZOKE operates a Partner Program through which approved individuals or businesses may refer customers to ZOKE and earn commissions on eligible purchases.

Applying to or participating in the ZOKE Partner Program constitutes acceptance of the separate ZOKE Partner Program Terms.

If there is a conflict between these Terms and the Partner Program Terms concerning Partner Program participation, the Partner Program Terms will apply to that matter.

16. Third-Party Services and Links

The Website may contain links to or integrations with third-party websites, applications, social networks, payment providers, delivery providers, or other services.

We do not control and are not responsible for third-party services, content, security, availability, or privacy practices.

17. Website Availability

We aim to maintain reliable Website availability but do not guarantee that the Website or every feature will always be uninterrupted, error-free, secure, or available.

We may temporarily suspend access for maintenance, upgrades, security, operational reasons, or circumstances outside our reasonable control.

18. Disclaimer

To the extent permitted by applicable law, the Website and its informational content are provided on an “as available” basis.

Nothing in these Terms excludes any warranty, obligation, or consumer protection that cannot legally be excluded.

19. Limitation of Liability

To the fullest extent permitted by applicable law, SIWARAH FZC shall not be liable for indirect, incidental, special, consequential, or purely economic losses arising solely from the use of, or inability to use, the Website or Services.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

20. Fraud and Abuse

We reserve the right to investigate suspected fraud, abuse, manipulation, unauthorized access, payment misuse, promotion abuse, referral abuse, or other prohibited activity.

Where reasonably necessary, we may refuse or cancel transactions, restrict accounts, withhold benefits that were obtained improperly, preserve relevant records, or cooperate with payment providers, financial institutions, regulators, or competent authorities.

Personal information collected through the Website and Services is handled in accordance with our Privacy Policy.

22. Changes to these Terms

We may update these Terms from time to time to reflect changes to our Services, policies, business operations, or applicable requirements.

Failure by SIWARAH FZC to exercise or enforce a right under these Terms does not constitute a waiver of that right.

25. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the applicable laws of the United Arab Emirates.

Subject to any mandatory consumer rights or jurisdictional requirements that cannot lawfully be excluded, disputes arising in connection with these Terms shall be subject to the jurisdiction of the competent courts of the United Arab Emirates.
